# How an FHA Loan Assumption Actually Works

The rate travels with the loan. So does the mortgage insurance — and so does the underwriting.

## Key takeaways

- An assumption transfers the existing loan to the buyer on its existing terms. The rate, remaining term, and balance travel with it.
- You still qualify. On FHA loans originated since December 1, 1986, the servicer reviews credit, income, and debts and can decline.
- The cash is the catch: you cover the gap between the price and the remaining balance, which on a seasoned loan is often larger than a normal down payment.
- Assuming an FHA loan does not reset or remove its annual mortgage insurance, and FHA assumptions generally require you to occupy the home.
Summary only. The detail, the current figures, and the disclosures are in the article below.

When existing loans carry rates below what is available on a new loan, assuming one starts to look attractive. An FHA assumption is a real path, not a loophole — and it has a specific cost structure that decides whether it helps your file. Snapshot as of 2026-08. This page does not quote assumption fees, promise that a specific loan is assumable, or predict approval. The servicer of that specific loan, and the note itself, are the source of truth.

## What an assumption actually is

An assumption transfers the existing loan to the buyer on its existing terms, rather than the buyer taking out a new loan. The rate, remaining term, and balance travel with the loan. Whether a given loan may be assumed is set by the note and the program, not by agreement between buyer and seller.

FHA and VA loans are generally assumable with agency and servicer approval. USDA loans can also be assumed, but the assuming buyer must meet USDA's own eligibility, including household income limits and property location, and some USDA loans are assumed on new rates and terms rather than the existing ones. Conventional loans usually contain a due-on-sale clause that lets the lender call the balance due on transfer, so they are typically not assumable, though federal law limits when that clause may be enforced, including on certain transfers between spouses and transfers resulting from a divorce decree or property settlement.

## Who can assume an FHA loan

An assumption is not a way around underwriting. The servicer typically reviews the buyer's credit, income, and debts to program standards, and can decline. An approved assumption is a decision on that buyer's file, not a formality.

FHA assumptions generally require the assuming buyer to occupy the property as a principal residence. Occupancy is a program rule on an assumption as much as on a new purchase. That makes an assumption a different conversation from buying a rental — occupancy is a program rule here, not a label you pick. See [second home vs investment occupancy](/blog/second-home-vs-investment-occupancy/).

Credit standards on an assumption come from a servicer creditworthiness review against FHA's requirements plus the servicer's own — not from the purchase down-payment matrix. An assuming buyer makes no down payment, so a minimum-score-and-down-payment figure from a purchase page does not transfer to this conversation. Program overview: [FHA loans](/loans/fha/).

## The step-by-step process

- 1 ### Confirm the loan is actually assumable Ask the seller for the servicer's name and the note. Whether the loan may be assumed is set by the note and the program, not by what the listing says.
- 2 ### Contact the servicer's assumption department This is a separate process from a normal origination, with its own packet and its own queue. Ask what they require and how long it typically takes.
- 3 ### Work out how you will cover the equity gap Price minus the remaining balance is yours to cover, in cash or through other financing. Settle this before you write an offer, not after.
- 4 ### Submit the application and documents Expect an income, credit, and debt review to program standards — the same stack described in [how underwriters verify income](/blog/how-underwriters-verify-income/).
- 5 ### Get the release of liability in writing Without a documented release of liability, a seller can remain responsible for the debt after the sale. Ask for it in writing as part of the assumption, not after closing.

## What it costs: the equity gap

The buyer must cover the difference between the purchase price and the remaining loan balance, in cash or through other financing. On a seasoned loan that gap is often larger than a normal down payment, which is why a low assumed rate does not automatically mean less cash to close.

Illustration: on a $450,000 purchase where the seller owes $270,000, the buyer covers roughly $180,000 to assume — before closing costs. That is the number that decides whether an assumption is available to you, and it has nothing to do with how good the rate is. Dollar figures on education pages are worked examples for illustration. They are not your payment, cash to close, or an offer of credit.

An assumed FHA loan keeps the mortgage insurance terms it already has. Assuming the loan does not restart or remove annual MIP; the original schedule travels with the loan. How FHA mortgage insurance ends is a separate question: [MIP vs PMI](/blog/mip-vs-pmi-how-mortgage-insurance-ends/). What else sits on top of the down payment: [Utah cash to close](/blog/utah-cash-to-close-besides-down-payment/).

## Assumption vs a new loan

### An assumption can help when

- The existing rate is meaningfully below what a new loan would carry, and you will hold the loan long enough for that to matter.
- You have the cash to cover the equity gap without straining reserves.
- You will occupy the property, so the FHA occupancy rule is not a problem.

### A new loan is usually simpler when

- The equity gap is larger than the cash you have, which is the usual reason assumptions fall apart.
- You need to close on a predictable timeline — servicer assumption queues are not an origination pipeline.
- You want the loan structured around your file: term, mortgage insurance, and product are fixed on an assumption.

## Pitfalls worth knowing before you offer

A low rate is not a low cash requirement

The headline on an assumption is always the rate. The number that decides whether you can do it is the gap between price and balance. A well-seasoned loan with an attractive rate is often the one with the largest gap, because the seller has paid the balance down and the property has appreciated.

Sellers: liability does not transfer by itself

Without a documented release of liability, a seller can remain responsible for the debt after the sale. Ask for it in writing as part of the assumption, not after closing. On a VA loan there is a second step as well — entitlement. See [VA loan assumption and entitlement](/blog/va-loan-assumption-entitlement/).

## What happens next

Get the servicer's assumption packet and the remaining balance in writing, then price a normal FHA or conventional file next to it. An assumption is worth pursuing when the cash works — not because the rate looks good. A loan officer can run both: [start a conversation](/qualify/). Assumptions run through the servicer's assumption department rather than a normal origination pipeline, and processing times vary widely. Build that uncertainty into contract deadlines instead of assuming a standard closing timeline.

## Common questions

### Do I still have to qualify to assume an FHA loan?

An assumption is not a way around underwriting. The servicer typically reviews the buyer's credit, income, and debts to program standards, and can decline. An approved assumption is a decision on that buyer's file, not a formality.

### Is an assumption cheaper than a new loan?

Not automatically. The rate may be lower, but you still have to cover the gap between the price and the remaining balance. On a seasoned loan that gap is often larger than a normal down payment, so the cash required can be higher even when the payment is lower.

### Does assuming an FHA loan get rid of the mortgage insurance?

An assumed FHA loan keeps the mortgage insurance terms it already has. Assuming the loan does not restart or remove annual MIP; the original schedule travels with the loan.

### Can I assume an FHA loan as a rental or second home?

FHA assumptions generally require the assuming buyer to occupy the property as a principal residence. Occupancy is a program rule on an assumption as much as on a new purchase.

### How long does an assumption take?

Assumptions run through the servicer's assumption department rather than a normal origination pipeline, and processing times vary widely. Build that uncertainty into contract deadlines instead of assuming a standard closing timeline.

### Is the seller off the hook once I assume the loan?

Without a documented release of liability, a seller can remain responsible for the debt after the sale. Ask for it in writing as part of the assumption, not after closing.

Education first. A conversation with a loan officer is how you find out what may actually fit your file.
